AI Generation Terms of Service

These AI Generation Terms of Service ("Generation Terms") govern your use of our artificial intelligence content generation services, including but not limited to image generation, pattern generation, and any other AI-powered creative tools (collectively, the "Generation Services"). By accessing or using the Generation Services, you agree to be bound by these Generation Terms in addition to our general Terms of Service.

1. Ownership of Generated Content

As between you and SecondStream, you own the content you generate through the Generation Services ("Generated Content"), along with the original creative input (such as text prompts and descriptions) that you provide. Subject to the limited license granted in Section 2 and the other provisions of these Generation Terms, you are free to use, publish, sell, and otherwise commercialize your Generated Content for any lawful personal or commercial purpose. You acknowledge that the scope of intellectual property protection available for AI-generated content may vary by jurisdiction, and SecondStream makes no representation regarding the copyrightability of any Generated Content.

2. Limited License Grant to Company

By using the Generation Services, you grant to SecondStream and its affiliates, successors, and assigns a perpetual, worldwide, royalty-free, non-exclusive license, sublicensable to our affiliates and service providers, to use, reproduce, modify, adapt, publish, publicly display, distribute, and create derivative works from Generated Content solely for the following purposes:

For clarity, SecondStream will not list or sell your Generated Content on third-party marketplaces (such as Etsy or similar platforms), and will not package, bundle, or sell your Generated Content to other customers or end users as a product. This restriction does not limit SecondStream's right to assign or transfer these Generation Terms, and the license granted above, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

3. Publication and Display Rights

You acknowledge and agree that, for the promotional purposes described in Section 2, SecondStream may publish, display, share, or otherwise make publicly available Generated Content without prior notice to you, without attribution, and without compensation. This includes but is not limited to featuring Generated Content on our website, social media channels, marketing materials, case studies, and galleries.

4. No Exclusivity

You understand and agree that: (a) the Generation Services may produce identical or substantially similar content for multiple users; (b) you have no claim to exclusivity over any Generated Content; (c) SecondStream is under no obligation to monitor, track, or prevent duplication of Generated Content; and (d) other users may receive, use, and publish content that is identical or substantially similar to your Generated Content.

5. File Hosting, Retention, and Local Backup

We host files created through the Generation Services as a convenience to you, not as a permanent storage or archival service. Generated files will remain available for you to download for a period of at least ninety (90) days from the date of generation (the "Retention Period"). After the Retention Period, we may remove any generated file from our servers at any time, for any reason, without prior notice to you.

You are solely responsible for downloading your Generated Content and maintaining your own local copies and backups. Removal of a file from our servers does not affect your ownership of the Generated Content, but SecondStream shall have no liability for any loss of, or inability to access, Generated Content that you have not downloaded and stored locally, whether during or after the Retention Period.

THE GENERATION SERVICES AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. SECONDSTREAM SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SECONDSTREAM DOES NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECONDSTREAM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GENERATION SERVICES OR ANY GENERATED CONTENT, INCLUDING THE REMOVAL OF GENERATED FILES FROM OUR SERVERS IN ACCORDANCE WITH SECTION 5.

10. Indemnification

You agree to indemnify, defend, and hold harmless SecondStream and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Generation Services; (b) your violation of these Generation Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to or generate through the Generation Services.

11. Modification of Terms

SecondStream reserves the right to modify these Generation Terms at any time. We will notify you of material changes by posting the updated terms on our website and updating the "Effective Date" above. Your continued use of the Generation Services after any such changes constitutes your acceptance of the new Generation Terms.

12. Termination

SecondStream may suspend or terminate your access to the Generation Services at any time, for any reason, without prior notice or liability. The limited license granted in Section 2 shall survive any termination of your access to the Generation Services. Following termination, we are under no obligation to retain or provide access to your generated files beyond the Retention Period described in Section 5.

13. Governing Law

These Generation Terms shall be governed by and construed in accordance with the laws of the jurisdiction specified in our general Terms of Service, without regard to its conflict of law provisions.
