AI Generation Terms of Service

These AI Generation Terms of Service ("Generation Terms") govern your use of our artificial intelligence content generation services, including but not limited to image generation, pattern generation, and any other AI-powered creative tools (collectively, the "Generation Services"). By accessing or using the Generation Services, you agree to be bound by these Generation Terms in addition to our general Terms of Service.

1. License Grant to Company

By using the Generation Services, you hereby grant to SecondStream and its affiliates, successors, and assigns a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, translate, publish, publicly perform, publicly display, broadcast, transmit, distribute, create derivative works from, and otherwise exploit any and all content generated through the Generation Services ("Generated Content"), in any format or medium now known or hereafter developed, for any purpose whatsoever, including without limitation:

• Commercial purposes, including sale, licensing, or distribution of Generated Content
• Marketing, advertising, and promotional materials
• Product development and service improvement
• Training, improving, and developing artificial intelligence and machine learning models
• Public display, publication, and exhibition
• Creation of compilations, collections, and derivative works
• Any other lawful commercial or non-commercial purpose

2. Publication and Display Rights

You acknowledge and agree that SecondStream may, at its sole discretion, publish, display, share, or otherwise make publicly available any Generated Content without prior notice to you, without attribution, and without compensation. This includes but is not limited to featuring Generated Content on our website, social media channels, marketing materials, case studies, galleries, and any other public-facing platforms.

3. Your Rights in Generated Content

Subject to the license granted above, you retain ownership of the original creative input (such as text prompts and descriptions) that you provide to the Generation Services. You may use Generated Content for your own personal and commercial purposes, provided that such use does not conflict with these Generation Terms or our general Terms of Service. You acknowledge that the same or similar Generated Content may be produced for other users, and you have no exclusive rights to any Generated Content.

4. No Exclusivity

You understand and agree that: (a) the Generation Services may produce identical or substantially similar content for multiple users; (b) you have no claim to exclusivity over any Generated Content; (c) SecondStream is under no obligation to monitor, track, or prevent duplication of Generated Content; and (d) other users may receive, use, and publish content that is identical or substantially similar to your Generated Content.

5. Representations and Warranties

By using the Generation Services, you represent and warrant that:

• You have the legal capacity to enter into these Generation Terms
• Any input you provide does not infringe upon any third-party intellectual property rights, privacy rights, or other legal rights
• You will not use the Generation Services to create content that is illegal, harmful, defamatory, obscene, harassing, threatening, or otherwise objectionable
• You will not attempt to generate content depicting real individuals without their consent
• You will comply with all applicable laws and regulations in your use of Generated Content

6. Prohibited Uses

You agree not to use the Generation Services to create content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
• Depicts illegal activities or promotes harm to any person or entity
• Contains sexually explicit material or depicts minors in any inappropriate context
• Promotes discrimination, hatred, or violence against any individual or group
• Constitutes unauthorized advertising, spam, or deceptive practices
• Impersonates any person or entity or misrepresents your affiliation with any person or entity

7. Disclaimer of Warranties

THE GENERATION SERVICES AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. SECONDSTREAM SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SECONDSTREAM DOES NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECONDSTREAM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GENERATION SERVICES OR ANY GENERATED CONTENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless SecondStream and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Generation Services; (b) your violation of these Generation Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to or generate through the Generation Services.

10. Modification of Terms

SecondStream reserves the right to modify these Generation Terms at any time. We will notify you of material changes by posting the updated terms on our website and updating the "Effective Date" above. Your continued use of the Generation Services after any such changes constitutes your acceptance of the new Generation Terms.

11. Termination

SecondStream may suspend or terminate your access to the Generation Services at any time, for any reason, without prior notice or liability. The license grants contained herein shall survive any termination of your access to the Generation Services.

12. Governing Law

These Generation Terms shall be governed by and construed in accordance with the laws of the jurisdiction specified in our general Terms of Service, without regard to its conflict of law provisions.
